Regulation (EU) 2023/1230 raises the bar significantly for documentation, market surveillance and responsibilities. EU authorities can request access to technical files at any time. For products falling under the Market Surveillance Regulation, an economic operator established in the EU must generally be present — depending on the supply structure, this can be an importer or an authorised representative. If no suitable contact is in place, manufacturers risk customs holds, market withdrawal or regulatory orders.

Our role

Your point of contact inside the European Union.

As EU Authorised Representative, ATAK Engineering acts as the official representative for manufacturers based outside the EU. We manage your technical files, provide documents to market surveillance authorities and support you on regulatory matters — permanently reachable in German, English and Turkish.

Under Article 12 of the Machinery Regulation, the manufacturer may appoint an authorised representative by written mandate. The Regulation does not frame this appointment as a general obligation for every non-EU manufacturer. The mandate may not transfer the manufacturer’s original obligations regarding design and preparation of technical documentation to the authorised representative.

For products falling within the scope of the Market Surveillance Regulation, an economic operator established in the EU must generally be available. Depending on the supply structure, this role may be fulfilled by an importer or an authorised representative. Our service is therefore especially relevant for manufacturers that do not have their own suitable and technically competent EU contact.

Without an EU economic operator

What is at stake.

If no EU-established economic operator is in place — or that contact is unreachable when an inquiry arises — the consequences are concrete and commercially tangible.

Customs hold

If no EU-established economic operator is named, shipments may be held at the EU external border.

Sales ban

Surveillance authorities can prohibit placing on the market if conformity is lacking or no EU contact is reachable.

Product recall

Non-conforming machines may have to be recalled or withdrawn from the EU market.

Market-entry delays

Project and delivery deadlines slip when documentation or a reachable EU contact is missing.

Sanctions

Regulatory breaches can lead to substantial fines — especially when no reachable EU economic operator is in place.
